RECOMMENDATIONS:
APPROVE and AUTHORIZE the Public Works Director, or designee, to execute an amendment to a license agreement with DISH WIRELESS, L.L.C., to expand DISH's premises at the County's radio tower facilities located at 1850 Muir Road, Martinez from 35-square feet to 100-square feet, and increase the annual fee from $22,356 to $25,709, as requested by the Department of Information and Technology, and as recommended by the Public Works Director. (100% to Department of Information and Technology).

FISCAL IMPACT:
Revenue - 100% to Department of Information and Technology.


BACKGROUND:
The County is the owner of real property located at 1850 Muir Road, Martinez, which is a portion of Assessor's Parcel Number 155-280-011, which has been improved with buildings and a radio communication site that includes, among other things, a tower.

On July 1, 2023, DISH Wireless, L.L.C. entered into a license agreement with the County for ingress and egress over an existing non-exclusive ten-foot-wide access easement to place and maintain a cabinet which houses wireless communication equipment on a 35-square-foot ground space and to install and maintain six antennae on the tower to support a new cell site. The initial term of the license agreement is five years with four five-year options to renew. The initial annual license fee was $21,600, with an increase of 3.5% annually.

When DISH placed its equipment per the original license agreement, it fenced 100 square feet of ground space instead of the 35 square feet allowed in the license. Now, it needs to install a PG&E meter on a five- to six-foot-tall, 60-inch-wide H-frame to hold a meter for power to their communication equipment.
