RECOMMENDATIONS:
APPOINT, in lieu of election, Russell E. Ryan and Randall Neudeck to the Board of Trustees of Reclamation District 2026 (Webb Tract) for four-year terms ending December 2027, as recommended by the County Administrator.
FISCAL IMPACT:

BACKGROUND:
The Clerk of the Board of Supervisors received correspondence from Pamela A. Forbus, Secretary/Attorney for Reclamation District 2026 (Webb Tract). On behalf of the Reclamation District, Ms. Forbus has requested that the Board of Supervisors make appointments to fill two seats on the District's Board of Trustees in lieu of election. A nominating petition was filed by two individuals, Russell E. Ryan and Randall Neudeck, for the office of Trustee. Ms. Forbus reports that the number of nominees who have filed nominating petitions does not exceed the number of offices to be filled and no petition requesting an election has been filed. Thus, pursuant to Water Code Section 50742 the District published notice that no election would be held. Therefore, the District requests that Russell E. Ryan and Randall Neudeck be appointed to the Board of Trustees for four-year terms ending December 2027, pursuant to Water Code section 50742.
CONSEQUENCE OF NEGATIVE ACTION:
The proposed nominees to the Board of Trustees for Reclamation District 2026 would not be approved, and the District’s Board of Trustees would have difficulty conducting business.
