RECOMMENDATIONS:
APPROVE and AUTHORIZE the Sheriff-Coroner, or designee, to execute a Memorandum of Understanding (MOU) with California Health and Recovery Solutions, P.C., to provide Early Access and Stabilization Services to felony court-ordered incompetent to stand trial (IST) incarcerated individuals at the Martinez and West County Detention Facilities, effective upon execution of the agreement through June 30, 2025, which is coterminous with the Department of State Hospitals (DSH) Agreement, and will automatically renew to remain coterminous with the DSH Agreement, unless terminated by either party as agreed upon in the MOU.

FISCAL IMPACT:
There is no fiscal impact.

BACKGROUND:
The Sheriff-Coroner would like to execute a Memorandum of Understanding with California Health and Recovery Solutions, P.C. to provide Early Access and stabilization Services (EASS). They offer restoration services virtually, in-person and a combination thereof for felony IST-incarcerated individuals awaiting placement in a program or state hospital. These individuals are currently incarcerated in the Martinez and West County Detention Facilities.

CONSEQUENCE OF NEGATIVE ACTION:
If the Board does not vote in favor, it will result in the Office of the Sheriff not complying with the new Legislature. The Legislature enacted Welfare & Institutions Code (WIC) section 4147 through the passage of Assembly Bill 133 (Chapter 143, Statutes of 2021) and the Budget Act of 2021 (Chapter 69, Statutes of 2021), which charged the California Health & Human Services Agency (CalHHS) and DSH to convene an IST Solutions Workgroup to identify actionable solutions that address the increasing number of individuals with serious mental illness who become justice-involved and deemed IST on felony char...
