RECOMMENDATIONS:

ADOPT a Resolution approving the side letter of agreement between Contra Costa County and the Deputy Sheriffs Association ("DSA") modifying Section 16 - Promotion of the Memorandum of Understanding ("MOU") governing wages, hours, and other terms and conditions of employment for the DSA's Management unit, to allow the Office of the Sheriff to use the "Rule of the List" for open and promotional recruitments for the Lieutenant (6XHA) and Captain (6XDA) classifications. On each request from the Office of the Sheriff for an employment list for these classifications, all names will be certified in rank order.

FISCAL IMPACT:

None.

BACKGROUND:

The Contra Costa County Personnel Management Regulations ("PMRs") and the MOU between Contra Costa County and the DSA do not authorize the Office of the Sheriff to receive a full, rank-order employment list from the Human Resources Department when it recruits for positions in the Lieutenant and Captain classifications. PMR Part 605.3(c) and PMR Part 711 authorize the Office of the Sheriff to receive such lists for these classifications if agreed to in an MOU between the County and a recognized employee organization that represents these classifications.

This side letter of agreement will enable the Office of the Sheriff to receive a full, rank-order employment list from the Human Resources Department when it recruits for positions in the Lieutenant and Captain classifications consistent with the PMRs.
