RECOMMENDATIONS:
APPROVE and AUTHORIZE the County Librarian, or designee, to execute an amendment to the Library's contract with Ax9 Security, Inc. to adjust the Concord Sunday security guard hours to accommodate extended open hours, add Sunday security guard services at San Pablo and Pittsburg libraries, and add a meal penalty rate for Sunday services, with no change to the payment limit or term.

BACKGROUND:
On May 20, 2025, the Board of Supervisors approved a Contract with Ax9 Security, Inc for unarmed security services on an as-needed basis at the Martinez, Concord, San Pablo, and Walnut Creek Libraries. The Contract term is July 1, 2025, through June 30, 2028, and the payment limit is $1,510,000.
Due to the self-service Sunday hours at Concord Library extending from 12:00-4:00pm to 12:00-5:00pm, it is necessary to adjust the open hours and security guard hours within the contract. Due to self-service Sunday hours launching at the San Pablo and Pittsburg libraries later this fiscal year, it is necessary to add security guard hours on Sundays at these two locations. The Library is also requesting to add a meal penalty rate to the contract payment provisions, which allows Ax9 Security, Inc. to charge the Library an additional fee to accommodate the Sunday security guards taking their required 30-minute lunch period on the premises. This is necessary because there are no Library staff on the premises on Sundays.
Government Code Section 31000 authorizes the County to contract for services including the services that Ax9 Security, Inc. provides.
CONSEQUENCE OF NEGATIVE ACTION:
