RECOMMENDATIONS:

APPROVE and AUTHORIZE the Purchasing Agent to execute, on behalf of the County Librarian, a purchase order including modified indemnification and limitation of liability language with Marcive, Inc. in an amount not to exceed $1,764 for the renewal of Marcive, Inc., Documents Without Shelves subscription for the period May 1, 2024, through April 30, 2025.

 

FISCAL IMPACT:

100% Library Fund.

 

BACKGROUND:

The Library Department has used and continues to use the Marcive, Inc. Documents Without Shelves subscription for its digital access solution for libraries that provides access to online government documents for the library’s patrons. Marcive offers direct access from the library catalog to over 250,000 documents published by the Government Printing Office. The service includes monthly updates to ensure accurate information.

 

The Terms and Conditions of the purchase order include an indemnification provision that obligates the County to hold Marcive, Inc., harmless from any claims of third parties arising out of or related to use of the Document Without Shelves database, and a limitation of liability provision that disclaims any liability for any damages, approved by County Counsel.

 

CONSEQUENCE OF NEGATIVE ACTION:

If the Purchase Order is not approved, the Contra Costa County Library patrons will not have direct access to over 250,000 digital government documents published by the GPO.
