RECOMMENDATIONS:
APPROVE and AUTHORIZE the Auditor-Controller, or designee, to pay an amount not to exceed $67,657.11 to Christian Eisert, M.D., to provide otolaryngology services at Contra Costa Regional Medical Center (CCRMC) and Health Centers), for the months of December 2025 and January 2026, as recommended by the Health Services Director.

FISCAL IMPACT:
Approval of this payment will result in a one-time expenditure of up to $67,657.11 and will be funded 100% by Hospital Enterprise Fund I revenues.

BACKGROUND:
Due to limited number of specialty providers available within the community, CCRMC and Health Centers rely on contracts to provide necessary specialty health services to their patients. This contractor has been providing otolaryngology specialty services, including but not limited to on-call coverage, consultation, training, medical and surgical procedures, and administrative support services since October 2018.

On February 7, 2023, the Board of Supervisors approved Contract #76-620-4 with Christian Eisert, M.D., in an amount not to exceed $1,320,000 for the provision of otolaryngology services at CCRMC and health centers, for the period February 8, 2023 through January 31, 2026.

Due to an increase in utilization of Otolaryngology services at CCRMC and health centers, additional services were requested by the County without sufficient time to amend the Contract. Contractor provided these services in good faith, which exceeded the original payment limit by $67,657.11.

Therefore, the County has determined that Christian Eisert, M.D., is entitled to payment for the reasonable value of their services under the equitable relief theory of quantum meruit. That theory provides that where a person has been asked to provide services wi...
