Report Title: Budget Amendment to Appropriate New Revenue from State for DUI Vertical Prosecution Program

RECOMMENDATIONS:
APPROVE Budget Amendment No. BDA-25-00173 authorizing revenue appropriations from the California Office of Traffic Safety in the amount of $242,625 to the District Attorney's Office to fund the Alcohol and Drug Impaired Driver Vertical Prosecution Program in FY2025-26.
FISCAL IMPACT:
100% state funding, matching funds are not required. This action will increase Fiscal Year 2025-26 revenue appropriations by $242,625 and increase corresponding expenditure appropriations by the same amount.
BACKGROUND:
The District Attorney's Office received Board of Supervisors’ approval and authorization on March 25, 2025, to apply for and accept grant funding from the California Office of Traffic Safety in an amount not to exceed $1,240,000 to fund the Alcohol and Drug Impaired Driver Vertical Prosecution Program. The California Office of Traffic Safety subsequently announced that the Contra Costa District Attorney’s Office has been awarded $323,500 for the Vertical Prosecution Program for the grant period October 1, 2025 to September 30, 2026. The purpose of this board order is to appropriate revenues and expenditures for FY 2025-26 (October 1, 2025 through June 30, 2026) which is consistent with the acceptance of the grant as previously approved by the Board.
CONSEQUENCE OF NEGATIVE ACTION:
The District Attorney's Office will not be able to appropriate revenues and expenditures consistent with acceptance of the State grant for the Alcohol and Drug Impaired Driver Vertical Prosecution program as approved by the Board.
