RECOMMENDATIONS:

ACCEPT the resignation of Reunuel D Cooke, DECLARE a vacancy in the Appointee 3 on the Kensington Municipal Advisory Council for a term ending on December 31, 2026, and DIRECT the clerk of the Board to post the vacancy.

 

 

FISCAL IMPACT:

BACKGROUND:

 

The Kensington MAC advises the Board of Supervisors, County Planning Commission, and the Zoning Administrator on land use issues and other concerns affecting the unincorporated community of Kensington. The Tree Arbitration Board (KMAC) is charged with the review of applications to establish the right of a property owner to seek the restoration of views and sunlight that existed when the property owner purchased their property, and to establish a process by which property owners may seek restoration of these views and sunlight when they are unreasonably obstructed by the growth of trees on another property within its jurisdiction. The Tree Arbitration Board’s jurisdiction is defined by Contra Costa County Tree Obstruction of Views Ordinance (Chapter 816-2 of the County Ordinance Code). Currently we have two vacancies and five active members on this advisory council. The term length is four years and there is no term limit.

 

CONSEQUENCE OF NEGATIVE ACTION:

 

The seat would not be declared vacant which would hinder the ability to recruit to fill the position and could cause quorum issues for the body.
